By accessing or using the platform, you confirm that you are at least 18 years old (or have parental consent), that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree, do not use the platform.
1. About Gwags.ng
Gwags.ng is a local discovery and booking marketplace operated by First Pristine Solutions Ltd, incorporated in Nigeria. The platform enables users to discover and book hotels, shortlets/apartments, restaurants, hangout spots, delivery services, and events, and to connect with skilled people — primarily in Gwagwalada, Abuja and across Nigeria.
Gwags.ng is a marketplace and directory platform. We are not a hotel, restaurant, delivery company, event organiser, or employment agency. We facilitate connections between users and independent third-party vendors and service providers. The actual services are provided by those third parties, not by First Pristine Solutions Ltd.
2. Eligibility
- You must be at least 18 years old to create an account or make a booking. By using Gwags.ng, you represent that you meet this requirement.
- If you are registering as a business or vendor, you represent that you have the authority to bind that entity to these Terms.
- Gwags.ng is intended for use within Nigeria. We make no representation that the platform is appropriate or available in other jurisdictions.
3. Your Account
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You must provide accurate and truthful information when registering and keep it updated.
- You must notify us immediately at support@gwags.ng if you suspect unauthorised access to your account.
- We reserve the right to suspend or terminate accounts that violate these Terms or that are involved in fraudulent or abusive activity.
4. Platform Use — What You May and May Not Do
You may:
- Browse listings, make genuine bookings, and place legitimate orders.
- Submit honest reviews of businesses and services you have actually used.
- List yourself as a professional in the People section, providing accurate personal and professional information.
- List your legitimate business as a vendor after completing registration.
You may not:
- Use the platform for any unlawful, fraudulent, or deceptive purpose.
- Submit false, misleading, or defamatory reviews, listings, or profiles.
- Scrape, crawl, or automatically extract data from the platform.
- Attempt to gain unauthorised access to our systems or another user's account.
- Upload viruses, malware, or any content intended to damage or disrupt the platform.
- Harass, threaten, or abuse other users or vendors.
- Use the platform to send spam or unsolicited commercial communications.
- Post content that is obscene, hateful, discriminatory, or that infringes third-party rights.
5. Listings and Vendor Responsibilities
If you list a business, property, or service on Gwags.ng, you agree that:
- All information you provide — prices, photos, descriptions, availability — is accurate, complete, and not misleading.
- You have all necessary licences, permits, and legal authority to offer the services listed.
- You will honour confirmed bookings and orders. Repeated cancellations or non-fulfilment may result in removal of your listing.
- You are solely responsible for the quality and safety of the services or goods you provide.
- You will not use the platform to advertise services that are illegal under Nigerian law.
First Pristine Solutions Ltd reserves the right to remove any listing at any time, without notice, that violates these Terms or that we determine, in our sole discretion, is harmful to users or the platform's integrity.
6. Bookings, Orders, and Transactions
- A booking or order placed through Gwags.ng constitutes a direct agreement between you and the relevant vendor or service provider, not with First Pristine Solutions Ltd.
- We do our best to display accurate information, but prices, availability, and service details are set and controlled by vendors. We are not responsible for errors in vendor-supplied information.
- Cancellations and modifications are subject to the individual vendor's cancellation policy, which is displayed at the time of booking.
- Gwags.ng is not liable for any failure by a vendor to deliver a booked or ordered service. See our Refund Policy for applicable remedies.
7. Payments and Paystack
All payments on Gwags.ng are processed by Paystack Technology Inc. We do not store, access, or transmit your card number, bank details, PIN, or CVV. Payment data goes directly to Paystack's PCI-DSS certified infrastructure. By making a payment, you also agree to Paystack's Terms of Service.
- Prices are displayed in Nigerian Naira (₦) unless otherwise stated.
- Transaction fees, if any, will be disclosed before you confirm payment.
- A payment is only confirmed once Paystack returns a successful transaction reference. Until then, no booking is guaranteed.
- First Pristine Solutions Ltd is not responsible for payment failures, declined cards, or errors arising within Paystack's infrastructure.
8. Personal Profiles (People Section)
- The People section allows individuals to list their skills, experience, and contact information to be discovered by others.
- By creating a public profile, you consent to your name, photo, skills, area, and contact details being publicly visible to all visitors of Gwags.ng.
- You may request removal of your profile at any time by deleting it from within the platform or contacting us.
- Gwags.ng does not verify the qualifications, licences, or professional credentials of individuals listed. Users who engage with listed individuals do so at their own risk.
- First Pristine Solutions Ltd is not responsible for any agreement, payment, dispute, or outcome arising from a connection made through the People section.
9. User-Generated Content
Any content you submit (reviews, photos, profile information, business descriptions) remains your property. By submitting it, you grant First Pristine Solutions Ltd a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that content on Gwags.ng and in marketing materials relating to the platform.
You represent that any content you submit does not infringe third-party rights, is not false or defamatory, and does not violate any law. We reserve the right to remove content that violates these Terms without notice.
10. Intellectual Property
The Gwags.ng name, logo, design, software, and all platform content created by First Pristine Solutions Ltd are protected by Nigerian and international intellectual property law. You may not copy, reproduce, modify, or distribute any part of the platform without our prior written consent.
11. Third-Party Services and Links
Gwags.ng integrates third-party services including Supabase (data storage), Vercel (hosting), and Paystack (payments). The platform may also display links to external websites. We are not responsible for the practices, content, or availability of any third-party service or website. Your use of third-party services is governed by their own terms and privacy policies.
12. Limitation of Liability
To the fullest extent permitted by Nigerian law:
- Gwags.ng and First Pristine Solutions Ltd are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied.
- We do not guarantee that the platform will be uninterrupted, error-free, or free from viruses.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the platform.
- We are not liable for the acts or omissions of vendors, service providers, or other users.
- We are not liable for the outcome of any engagement, transaction, or connection made through the People section.
- Our total liability to you for any claim arising from these Terms or your use of Gwags.ng shall not exceed the amount you paid to First Pristine Solutions Ltd in the 3 months preceding the claim. Where no payment was made, our liability is zero.
Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
13. Indemnity
You agree to indemnify, defend, and hold harmless First Pristine Solutions Ltd, its directors, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the platform; (b) content you submit; (c) your violation of these Terms; or (d) your violation of any third-party rights.
14. Availability and Service Changes
We reserve the right to modify, suspend, or discontinue any part of Gwags.ng at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the service. We will endeavour to give reasonable notice of significant changes where possible.
15. Termination
You may close your account at any time by contacting support@gwags.ng. We may suspend or terminate your account immediately, without notice, if you breach these Terms. Upon termination, your right to access the platform ceases, though provisions that by their nature should survive (Limitation of Liability, Indemnity, Governing Law) will continue to apply.
16. Governing Law and Disputes
These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising from these Terms or your use of Gwags.ng shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the jurisdiction of the courts of Abuja, Federal Capital Territory, Nigeria.
17. Changes to These Terms
We may update these Terms from time to time. We will notify registered users by email of material changes and update the "Last updated" date at the top. Continued use of Gwags.ng after changes take effect constitutes acceptance of the revised Terms.
